Practice Overview

One of Canada's most respected advocates, the Honourable Ian Binnie served for nearly 14 years as a Justice of the Supreme Court of Canada. When he retired in 2011 he was described by The Globe and Mail as "arguably the country's premier judge" and by La Presse as "peut-être le juge le plus influent au Canada dans la dernière décennie."

During his time on the country's top court (as only the third modern Justice appointed directly from the bar) Ian authored more than 170 opinions, including in landmark cases involving corporate and commercial disputes, issues of patent interpretation and validity, protection of trade-marks, media law, punitive damages, expert evidence and many aspects of constitutional, criminal and administrative law.

  • September 1986 to January 1998: General litigation practice before all levels of court and administrative tribunals, including a number of leading civil and constitutional cases before the Supreme Court of Canada and international tribunals.
  • Legal Counsel to the Joint Committee of the Senate and House of Commons on the Meech Lake Accord 1987, retained by federal government to defend constitutional validity of the Free Trade Agreement; of counsel for Canada before the International Court of Arbitration against France in the St. Pierre and Miquelon boundary dispute; acted for Canadian Pacific against government legislation. regulating Western Canadian grain rates; frequently retained by the Canadian Broadcasting Corporation in libel and free press issues; retained by governments of Canada, Ontario, Newfoundland, New Brunswick and Yukon on various public law and aboriginal rights matters; major patent litigation for Imperial Oil, Unilever pLc, and other major clients; regulatory litigation for pharmaceutical drug issues for Merck Frosst Canada Inc. and Merck & Co., Inc.; represented major clients (American Airlines, Purolator Courier Ltd., Onex Corporation) in various proceedings before the National Transportation Agency; land use litigation for City of Hamilton, City of Toronto, and private developers such as First City Developments; retained on judicial review matters by Institute of Chartered Accountants of Ontario, Ontario Securities Commission, Dryden Air Crash Inquiry; several constitutional cases as counsel for the Senate of Canada, including litigation in the Supreme Court of Canada in respect of the conflict between Parliamentary privilege and freedom of the press; legal counsel to the House of Commons Charest Committee on the Constitution, 1990; Interesting cases include the Parker Commission of Inquiry into conflicts of interest in the federal Cabinet (1986).
  • September 1982 to August 1986: Associate Deputy Minister of Justice for Canada; responsibilities included all litigation for and against Her Majesty in right of Canada except tax cases and Quebec civil litigation; constitutional advisor to the government of Canada including Charter and Aboriginal rights issues; member of Canada’s legal counsel at the International Court of Justice at the Hague against the United States in the Gulf of Maine boundary dispute; work with the Department of Justice required frequent argument in the Supreme Court of Canada, advice on proposed legislation (e.g. amendments to Combines Investigation Act, Kent Commission on the Press, Federal Court Act amendments, Aboriginal self-government proposals) and general work in legal policy areas (e. g. native rights, administrative law reform).
  • Prior to September 1982: Private practice in Toronto with Wright & McTaggart and successor firms; prominent law cases included a successful challenge in the Supreme Court of Canada to Marshall Crowe sitting as Chairman of the National Energy Board on the McKenzie Valley Pipe Line, [19781 1 S.C.R. 369; a successful lawsuit against Burroughs Computers that was (at that time) the second most protracted civil trial in Ontario history, (1977) 15 O.R. (2d) 750; counsel to the City of Hamilton in litigation respecting federal/provincial dispute in land use jurisdiction against the Hamilton Harbour Commission and the Attorney General of Canada, (1979) 21 O.R. (2d) 459. Retained by Department of Justice (Ottawa) to advise regarding competition law implications of various mergers including Hudsons Bay Company bid for Simpson’s, and Thomson bid for Hudsons Bay Company. Frequently appeared before Ontario Municipal Board in matters involving land development (Metro Centre – Toronto railway lands), shopping centres (Sudbury, Val Est, North Bay); Ontario Labour Relations Board, etc.
