Christopher Harris KC succeeds in s.68 challenge to investor-State arbitration award

In a judgment handed down today, Mr Justice Bryan ruled that the eminent tribunal in the Republic of Kazakhstan v World Wide Minerals Ltd & Ors [2025] EWHC 452 (Comm) investor-State arbitration had committed a serious irregularity by failing to deal with Kazakhstan’s central argument in respect of causation in a 174-page award.  This award was itself produced in remitted proceedings following an earlier successful s.68 challenge.

Christopher Harris KC was lead counsel for the successful applicant, the Republic of Kazakhstan, instructed by Oliver Rawkins and Lucy Winnington-Ingram at Reed Smith.  He also appeared in the underlying arbitration.
