Court of Appeal dismisses apparent bias claim

The Court of Appeal has handed down judgment in Bubbles & Wine Ltd v Lusha [2018] EWCA Civ 468, in which it dismisses an allegation of apparent bias arising from a private conversation between the judge and counsel for one of the parties, during a trial.

The decision provides valuable guidance on the proper limits of communications between judges and counsel whilst proceedings are ongoing. The text of the decision can be found here.
