Jonathan Davies-Jones QC and William Edwards win for Standard Chartered Bank (Hong Kong)Ltd

In one of the first Commercial Court decisions to consider the scope of the illegality defence in the light of the law as re-formulated by the Supreme Court in July 2016 in Patel v Mirza, 3VB’s Jonathan Davies-Jones QC and William Edwards, instructed by DLA Piper, obtained judgment for US$168M in favour of  the claimants, Standard Chartered Bank (Hong Kong) Ltd and Standard Chartered Bank Malaysia Berhad.

Proceedings were started by the claimant banks in 2013 and jurisdiction was contested up to the level of the Supreme Court by the defendants, Independent Power Tanzania Ltd, VIP Engineering and Marketing Ltd and Pan African Power Solutions (T) Ltd.   The Supreme Court dismissed their application to appeal.
