Rory Phillips KC Appears in Landmark IPT Case Involving Guantanamo Bay Detainees
The Investigatory Powers Tribunal this week handed down its open judgment in Al-Hawsawi v Security Service and Others and Al-Nashari v Security Service and Others. Rory Phillips KC appeared for the Respondents, the UK’s Security and Intelligence Services and the Ministry of Defence.
The two Claimants, who have been detained by the United States at Guantanamo Bay for more than 20 years, brought complaints in the Tribunal, alleging that the UK authorities had acted unlawfully and were complicit in their detention and mistreatment by US officials.
In its open judgment, the Tribunal rejected all of the public law grounds advanced by the Complainants and made no determination in their favour. A closed judgment was also issued.
