Second Edition of DIFC Courts Practice Published

The Second Edition of DIFC Courts Practice, edited by Tom Montagu-Smith KC (3VB) and Rupert Reed KC (Serle Court), has been published by Edward Elgar publishing.

DIFC Courts Practice is the leading work on DIFC law and procedure, endorsed by the DIFC Courts as the official supplement to its rules. Written by a team of leading practitioners in the field, the thoroughly revised second edition includes discussion of DIFC law and detailed commentary on the Rules of the DIFC Courts, focusing on the substantive law of the DIFC, including on the jurisdiction of its Courts, and the full text of the Rules with expert commentary on their application and interpretation, including comprehensive analysis of all relevant case law.

DIFC Courts Practice continues to be an indispensable resource for all those involved in litigation in the DIFC Courts used by both judges and legal practitioners. It is regularly cited in judgments and a valuable resource for those involved in arbitration and in the enforcement in the DIFC and onshore Dubai of judgments and arbitral awards from other jurisdictions.

In his foreword to the second edition, Justice Sir Jeremy Cooke says that the work “…tells the practitioner essentially all he needs to know about how to grapple with the DIFC Courts’ system and procedures. I cannot speak too highly of this work and am happy to endorse it and recommend [it] as a paradigm example of what a Commercial Court Rule book should be.

In anticipation of the book’s release, the Editors and contributors have collaborated on a series of webinars aimed at discussing recent developments in the DIFC courts. The series provides a comprehensive review of DIFC law in 2024 that should be as useful to young practitioners as it may be interesting to veterans of the DIFC Courts.

This series will culminate with an in-person book launch and drinks reception to be held at The Ritz Carlton, DIFC, Salon 1 from 17:30 to 21:00 (GST) on Wednesday, 18 September 2024. Tom Montagu-Smith KC was named Commercial Silk of the Year at the Legal 500 MENA Awards. Tom drafted the Rules of the DIFC Courts, Dubai World Tribunal and the Courts of the Astana International Financial Centre Courts, where he sits as a judge.
