Sir William Blair and Judy Fu write for Arbitration International on the evolution of international dispute resolution involving Chinese enterprises
Sir William Blair and Judy Fu have co-authored an article for Arbitration International alongside Yang Zhao, Weiyao Han and Xiongfeng Li, titled ‘Evolution of dispute resolution clauses and mechanisms in the international business contracts of China’s enterprises—a forward look.’
The article considers the evolution of dispute resolution for Chinese enterprises as China’s role in international business continues to mature. The authors consider how arbitration agreements – particularly agreement on governing law, choice of seat, and arbitration institutions – serve as a bellwether for broader shifts in practice. They also examine the extent to which China’s approach may diverge from existing international models and explores how Chinese enterprises increasingly seek a ‘homeward’ trend, favouring arbitration in Greater China, together with a growing push for mediated settlements.
