Success for William Edwards in Commercial Court Trial Securing Recognition of UAE Judgment

William Edwards has obtained the recognition in England and Wales of a judgment of the UAE courts for AED 211 million (£47.5 million) together with orders under section 423 of the Insolvency Act 1986 reversing dispositions of property and cash by the judgment debtor to his son following a 4-day trial in the Commercial Court.

In a judgment handed down on 12 May 2023, David Edwards KC, sitting as a judge of the Commercial Court, comprehensively dismissed the attempts to resist enforcement and found that the various dispositions of property were made for a prohibited purpose. The judgment contains an important analysis of the mental element in a claim under section 423.
