3VB successfully defends £1.4bn fraud trial brought by SKAT (the Danish tax authority)

Following a trial lasting a year and a day between April 2024 and April 2025, the Commercial Court (Andrew Baker J) has handed down judgment in Skatteforvaltningen v Solo Capital Partners & ors [2025] EWHC 2364 (Comm), dismissing all claims brought by the Danish tax authority (SKAT) against multiple defendants.

The Court found that SKAT was not misled because none of the alleged implied representations was made and SKAT was not induced thereby to pay dividend tax refunds. The Court also held that the Defendants did not understand the representations to have been made or intend SKAT to rely on them.

The trial was the longest in the history of the Commercial Court to date.
