Jane returned to the Bar in 2014, having spent many years working for two of the world’s leading law firms, Shearman & Sterling LLP and, Freshfields Bruckhaus Deringer LLP. Jane is a Fellow of the Institute of Chartered Accountants in England & Wales and a Fellow of the Chartered Institute of Arbitrators. Jane was managing editor of the IBA journal Construction Law International from 2016 to 2018, and vice/co-chair of the IBA International Construction Projects dispute resolution subcommittee from 2018 through 2021. Jane is also one of the founding members and vice-chair of 3VB's International Advisory and Dispute Resolution Unit, regularly providing capacity building and pro bono/quasi pro bono assistance to State Attorneys and practitioners across Africa. Jane was the first chair of the Equal Representation in Arbitration Pledge Bar Subcommittee, she was a member of the task force who prepared the ICC Guide on Disability Inclusion in International Arbitration and is the current co-chair of the International Bar Association subcommittee on Innovation in International Construction Projects.

  • Instructed as counsel in an ICC arbitration concerning a terminated LNTP for a hydroelectric scheme in Africa.
  • Instructed as co-counsel by a contractor in an ICC arbitration in relation to a terminated power plant project in Saudi Arabia.
  • Instructed by a Brazilian power company, the purchaser of four coal-fired power plants in Brazil.  Jane provided advice and assistance in relation to termination of the EPC contracts (Brazilian law), pre-ICC arbitration advice (potential claims in excess of US$1 billion), calls on performance bonds (Portugal, Italy, Brazil and England), terms of settlement and implementing settlement arrangements.
  • Instructed as counsel by a Chilean power company in four consolidated Spanish-language ICC arbitrations in relation to the supply of a coal-fired power station in Chile (claims in excess of US$1 billion). In addition, Jane advised in relation to calls on performance bonds in multiple jurisdictions (Chile and Italy, in excess of US$100 million collected), and assisted in the negotiation of a settlement with the contractors and parent company guarantors.
  • Instructed as counsel for a section 68 challenge in the English High Court relating to ICC Awards concerning the termination of contracts to construct a power plant in Kabul, Afghanistan including appeal.
  • Instructed as counsel in an ICC arbitration concerning a Jordanian wind farm project.
  • Instructed as counsel by a UK based power company in an LCIA arbitration concerning the termination of an electricity and gas supply agreement for a UK power plant.
  • Instructed as counsel by an international power plant supplier in Eastern Europe in an UNCITRAL arbitration in relation to the supply of a refurbished transformer to the local state power generator. Jane also advised in relation to the settlement of the dispute.
  • Advising a contractor in relation to claims arising in relation to the redevelopment of the Huntley power station in New Zealand.
  • Advising in relation to a dispute concerning a biomass plant in England.

Counsel appointments – advisory:

  • Advised an international power company in relation to the London Array offshore wind farm (175 turbines, project value approximately £1.8 billion).
  • Providing in-house training to an international investment bank’s project finance team in Paris (EPC contracting for different types of power generation project).
  • Advising a contractor in relation to the development of a geothermal power plant in New Zealand.
  • Advised a US Aid funded initiative on contracting strategy for transmission lines in East Africa (pro bono).

Nuclear new-build: 

Jane has significant experience of new-build nuclear projects.  She is standing external counsel to a nuclear supplier for the new-build NPP, and has advised owners, tier 1 and tier 2 contractors in relation to the following projects:

  • Hanhikivi-1 NPP (Finland).Representing the nuclear supplier/investor in dispute board proceedings and international arbitrations (ICC, various seats/laws) following termination of the Project.
  • Olkiluoto NPP (Finland).  Representing the plant supplier in international arbitration (ICC, Stockholm seat, Finnish law) and advising in relation to contract and claims management, dispute board proceedings etc.
  • Visaginas NPP (Lithuania). Advising a construction company in relation to its participation as civil works designer / contractor and/or manager, and potential joint venture arrangements.
  • Beznau and Műhleberg NPP replacement (Switzerland).  Advising a Swiss power company, the prospective developer, in relation to the procurement of two NPP.
  • Wylfa and Oldbury NPP (United Kingdom). Advising an international construction company in relation to its participation as civil works designer / contractor and/or manager and potential joint venture arrangements with European design companies.
  • Hainau NPP (China). Advising the supplier of the I&C system, in relation to the supply contract.

Jane has advised in relation to a number of significant projects in the mining sector, together with other natural resource projects. Example projects include:

  • Advising in relation to settlement of a dispute concerning latent defects discovered at a pulp mill in Chile.
  • Advising the owner in relation to potential dispute arising on a pulp mill project in Brazil.
  • Advising Baikal Mining in relation to contracting strategy and project documentation for the exploitation of the Udokan copper deposit in Siberia and assisting in negotiations with an international services provider.
  • Advising the Russian owner in relation to the purchase of the world’s largest HBI-3 plant for installation in the Russian Federation.
