Catherine Gibaud KC and Devon Airey have contributed to Practical Law’s Finance Column on the topic of asymmetric jurisdiction clauses in finance agreements. Catherine and Devon examine recent cases in English and EU law on how asymmetric jurisdiction clauses affect the likelihood that EU courts will decline jurisdiction or stay proceedings in favour of English courts.
