Clarissa Jones has successfully acted for the National Crime Agency in an application under POCA 2002 for an account forfeiture order. The judge found that the funds had been obtained via an unregistered, and therefore illegal, money service business, also referred to as “underground banking”. The Respondent’s good faith and proportionality defences also failed.
