Ian Wilson QC co-authors The Risk in The Rescue article with Enyo Law
Ian Wilson QC and Louise Bell, Partner at Enyo Law, have co-authored an article entitled “The Risk in The Rescue”.
The article describes in detail the duties and potential liabilities of Monitors under the Corporate Insolvency and Governance Act, which has been raced through Parliament on an emergency basis in response to the COVID-19 pandemic and which came into force on 26 June 2020. The Act creates a new moratorium process and a new role for insolvency practitioners as Monitors. The article considers in particular the immunity purportedly granted to Monitors under the Act and examines its effectiveness.
