JONATHAN NASH QC AND HANNAH GLOVER WIN KEY PRIVILEGE ARGUMENT IN RBS CASE

In one of the most important recent decisions on the scope of legal advice privilege, 3VB’s Jonathan Nash QC and Hannah Glover, instructed by Signature Litigation, successfully obtained disclosure of documents sought by the Claimants in the ongoing RBS Rights Issue litigation.
Applying the controversial decision in Three Rivers (No 5) [2003] QB 1556, Hildyard J found that notes of interviews with current and former employees of RBS as part of an investigation by in-house and external lawyers are not privileged as a matter of English law.
