Jonathan Nash QC and William Edwards succeed in dispute over Ownership of Market Sites in Moscow

In Rogachev v Goryainev [2019] EWHC 1529 (QB), a dispute between two wealthy Russian businessmen about the ownership of market sites in Moscow, Jonathan Nash QC and William Edwards were instructed by White and Case LLP for the successful Defendant in obtaining the discharge of a freezing injunction on the grounds of non-disclosure at the first hearing; and resisting the grant of a further freezing injunction or proprietary injunction on the basis that the Claimant was not entitled to any form of injunctive relief. The case illustrates the dangers of making applications in the English court without thinking through the complexities of the claim, and shows the great importance which the court places on a fair presentation of the facts at the without notice hearing.
