Rajesh Pillai KC and Sarah Parker have written an article for the ICC Institute Dossier XXII. The article: ‘Good faith principles in the interpretation of arbitration agreements’ draws on the approaches adopted under two prominent civil law and common law systems: the Dutch system of law and the law of England and Wales. These systems provide an informative counterpoint to each other, lying as they initially appear to at either end of the spectrum regarding the role of good faith in the interpretation of arbitration agreements. The chapter explains approaches taken to the interpretation of arbitration agreements with particular attention to pathological clauses and multi-tiered dispute resolution clauses.
Rajesh and Sarah wrote the chapter alongside Gerard Meijer and Piotr Wilinski for the ICC Institute of World Business Law volume: Good Faith in International Arbitration – A Versatile Chameleon.
