Victor Steinmetz has contributed the chapter on ‘European law and investment treaties’ to the latest edition of Lexology In-Depth: Investment Treaty Arbitration.
The chapter examines the impact of the Court of Justice of the European Union’s decisions in Achmea, Komstroy and PL Holdings on intra-EU investment treaty arbitration. It considers the termination of intra-EU bilateral investment treaties, the EU’s withdrawal from the Energy Charter Treaty, and the challenges investors face when seeking to enforce arbitral awards both within and outside the European Union. The chapter also explores the implications for ICSID and commercial arbitrations, and the future direction of investment dispute resolution within the EU.
