David Head QC successfully maintains £34m Worldwide Freezing Injunction

On 13 November 2019, Mrs Justice Carr handed down judgment in the Commercial Court in the case of The World LLC v Dalal [2019] EWHC 2993 (Comm), dismissing the Defendant’s application to discharge a worldwide freezing injunction in the sum of £34m. Heard over three days, the Defendant’s application alleged that the Claimant had misrepresented and failed fairly to present material facts at an ex parte hearing before Teare J in April 2019, including the potential defences available as to the enforcement in England and Wales of a Dubai judgment. Among other things, the Defendant alleged that the Claimant had obtained the Dubai judgment by fraud and/or that the judgment was incompatible with a judgment of the Dubai World Tribunal in related proceedings. Instructed by Norton Rose Fulbright on behalf of the Claimant, a UAE company engaged in the development of man-made islands offshore from Dubai, 3VB’s David Head QC successfully resisted the application (which was dismissed with costs) and maintained the freezing injunction until trial.
