The FCA in the Upper Tribunal

3VB are pleased to invite you to ‘The FCA in the Upper Tribunal’ panel discussion on Thursday 26th June 2025.

Philip Hinks and William Day will discuss recent developments in the Upper Tribunal concerning the imposition of financial penalties on FCA authorised persons and confidentiality applications, including:

  • Arian Financial LLP v The FCA [2024] UKUT 00352 (TCC) concerning the approach to be followed when applying the FCA’s penalty-setting regime;
  • Fox-Bryant v The FCA [2023] UKUT 00224 (TCC) and Dunne v the FCA [2024] UKUT 416 (TCC) on privacy applications in references to the Upper Tribunal;
  • Upper Tribunal ruling in the case of Craig Donaldson and David Arden who were knowingly concerned in a breach of the Listing Rules
