Paul Bonner Hughes successfully appeals dismissal of joinder application
Earlier today, the Court of Appeal handed down a judgment allowing an appeal of an order dismissing an application by a third party to be added as a defendant to an existing claim pursuant to CPR 19.2(2). The applicant/appellant is a shareholder and former director of the defendant company. The judgment contains a detailed analysis of the test under CPR 19.2(2) and its application in circumstances where both the claimant and the existing defendant to a claim are alleged to be under the ultimate control of the same individual.
Paul Bonner Hughes acted for the successful applicant/appellant (led by Georgios Petrochilos KC and Tariq Baloch KC), instructed by Three Crowns LLP, both in the Court of Appeal and the High Court. The claim arises from an underlying arbitration, in which Paul also acts.
