3VB Cases Feature Prominently in GAR Awards Shortlist for Most Important Decision
Global Arbitration Review (GAR) has published the shortlist for Most Important Decision of the Year as part of its 16th annual GAR Awards. Members of 3VB feature prominently, with involvement in six of the shortlisted decisions, described below.
Obligations of States in respect of Climate Change
The International Court of Justice held that states have binding obligations under treaties and customary international law to prevent climate harm.
3VB’s Catherine Drummond appeared as counsel for Antigua and Barbuda, and Associate Member Callista Harris appeared as counsel for Australia.
Operafund & Anor v Spain
The Commercial Court in London found that awards rendered under the ICSID Convention or the Energy Charter Treaty are not assignable.
3VB’s Cameron Miles represented Spain. The Claimants and a litigation funder, Blasket, were represented by 3VB’s Mark Wassouf.
Star Hydro Power v National Transmission and Despatch Company
The Court of Appeal restrained a “pre-emptive” challenge to an arbitral award before the Pakistani courts.
3VB’s Catherine Drummond appeared as counsel for the National Transmission and Despatch Company Limited.
Caster Semenya v World Athletics
The Grand Chamber of the European Court of Human Rights held that the Swiss courts’ review of a CAS award violated the athlete’s human rights.
3VB’s Can Yeginsu represented the United Nations High Commissioner for Human Rights, Mr. Volker Türk, before the Grand Chamber.
Indus Waters Treaty
A Court of Arbitration seated in The Hague issued significant interpretations of the Indus Waters Treaty between Pakistan and India.
3VB’s Cameron Miles and Associate Member Professor Attila Tanzi represented Pakistan before the Court of Arbitration.
Exxon v Hess
An ICC tribunal rejected ExxonMobil’s attempt to block its partner in a major Guyanese oil project from completing a US$53 billion merger with Chevron.
A 3VB team comprising Ali Malek KC, Ewan McKendrick KC (hon), Philip Hinks, Mark Wassouf, Ian McDonald and Emma Hughes advised Chevron in connection with the dispute.
The awards ceremony will take place in Paris on 26 March during Paris Arbitration Week, at the Pavillon Gabriel in the gardens of the Champs-Élysées.
