Members of 3VB contribute to The Practitioner’s Guide to Global Investigations – Tenth Edition
Saima Hanif KC, Tom Rainsbury, Ryan Ferro, and Clarissa Jones have co-authored an Insight Article titled “Injunctive relief in investigations: the UK perspective” for the Tenth Edition of The Practitioner’s Guide to Global Investigations, published by Global Investigations Review (GIR).
Now in its tenth edition, the Guide is a practical resource for external and in-house counsel, compliance officers, and accounting practitioners. Chapters are written by leading experts from around the world and are available to GIR’s readers to view and download free of charge.
Part I of the Guide provides an in-depth overview of the law, practice, and procedure applicable to investigations in the United Kingdom and United States. Part II brings together insights from local specialists across major jurisdictions, who respond to a comprehensive set of questions designed to highlight key local nuances in cross-border investigations.
The 3VB team’s contribution explores the role of interim injunctive relief in UK investigations – relief that is often sought urgently by regulatory or law enforcement authorities before court proceedings are issued. The article examines various forms of relief, including asset freezing orders, compelled disclosure orders, and search orders, as well as the procedural considerations arising from applications made without notice or in private.
The chapter sets out general principles relevant to such relief, identifies specific statutory injunctions and issues commonly encountered in practice, and concludes with a comparison to commercial injunctions and practical guidance for those served with investigative injunctions.
